حديث الثلاثاء: الحق في الحصول على المعلومات وتعزيز الممارسة الديمقراطية

يعتبر الحق في الحصول على المعلومات إحدى آليات الشفافية وتيسير الرقابة على السياسات العمومية والمشاركة في الحياة العامة، باعتباره حقا مدنيا وسياسيا نادت به كل المواثيق الدولية. وبالرجوع إلى الوثيقة الدستورية المغربية لسنة 2011، نجدها قد كرست هذا الحق من أجل تقوية المسار الديمقراطي الذي يعرفه المغرب، وذلك من خلال تمكين الرأي العام الوطني من إحدى الآليات المهمة في الممارسة الديمقراطية، ألا وهي الحصول على المعلومات للمشاركة في الحياة العامة. وفي هذا الإطار تم سن القانون 31.13 المتعلق بالحق في الحصول على المعلومات، كأول قانون ينظم كيفية حصول المواطنين المغاربة على المعطيات والوثائق الموجودة في حوزة الإدارات العمومية. كما مكن صدور القانون رقم 31.13 المتعلق بالحق في الحصول على المعلومات، من استكمال شروط انضمام المغرب إلى مبادرة الشراكة من أجل الحكومة المنفتحة سنة 2014 كما تم إعداد خطة وطنية لبلوغ أهداف هذه العضوية سنة 2018.فمن له الحق في الوصول إلى المعلومة وما هي الهيئات التي من شأنها ومسؤوليتها ضمان حسن ممارسة الحق في الحصول على المعلومات؟  أين نحن الآن من اهداف انضمام المغرب إلى مبادرة الشراكة من أجل الحكومة المنفتحة؟

Raja Bensaoud is a private law jurist, specializing in business and digital law. Her teaching career leads her to share her knowledge at the Royal College of Higher Military Studies as well as at several institutions of excellence such as Hassan 1st University and ISCAE.
